Crown Proceedings 〈英〉王权诉讼 指根据1947年《王权诉讼法》〔Crown Proceedings Act〕而对英王提起的合同或侵权诉讼。历史上,完美无瑕的君主特权(国王不为非)导致的最初结果是:不仅君主个人,而且王室本身(包括政府各部及其他一切作为王室的代理机构的公共团体)皆享有法律诉讼〔legal proceedings〕豁免权。但嗣后逐渐可对王室提起因违反合同而要求损害赔偿金或要求恢复财产之诉。诉讼的程式是一种权利请愿书〔petition of right〕(非普通诉讼〔ordinary action〕),1860年《权利请愿法》〔Petition of Right Act〕最终对此种程序进行了规范。1947年《王权诉讼法》以普通诉讼替代了权利请愿。其也使王国政府可因下列行为而被诉:因受雇的任何公务员或代理人在受雇期间作出的侵权行为,违反作为僱主及财产占用人所应尽的义务,以及违反对王国政府有约束力的法定义务。于今,公民一般可以在合同或侵权诉讼中,对英王提起诉讼,其如同具有完全权利能力和行为能力的私人一样。
